The Importance and Challenges of Privacy in Social Life: A Critical Review in the Light of Divine Teachings and Pakistani Laws

Privacy is a fundamental human right that ensures the protection of individuals from unwanted intrusion and preserves their dignity, freedom, and autonomy. This study critically examines the concept, definition, and significance of privacy in social life through the lens of Islamic teachings and Pakistani legal frameworks. Linguistically, privacy refers to concealing or keeping matters confidential, while in Arabic, it is linked to حقوق الخصوصیۃ, meaning an individual’s exclusive rights over personal matters. Islamic jurisprudence considers privacy a core human right, emphasizing that personal acts remain private unless voluntarily disclosed. The Prophet Muhammad ﷺ highlighted the sanctity of concealment and the moral consequences of violating privacy. Modern Pakistani laws, including cybercrime and terrorism prevention regulations, criminalize unauthorized intrusion, online harassment, misuse of personal data, and distribution of obscene content, imposing fines and imprisonment as deterrents. The study identifies the challenges posed by technological advancements, social media, and cultural practices that compromise personal privacy. Integrating theological, ethical, and legal perspectives, this research underscores the need for awareness, respect for individual rights, and stringent enforcement of privacy laws. Upholding privacy is not only a moral and religious obligation but also a societal necessity, ensuring the protection of human dignity, preventing abuse, and maintaining social harmony. The findings emphasize that both individuals and institutions must collaborate to safeguard privacy in the digital and physical realms.
