Abstract

This research explores the Islamic legal maxim (Qawāʿid Fiqhiyyah)"al-Yaqīn lā yazūl bi al-Shakk" (certainty is not overruled by doubt), which serves as a foundational principle in Islamic jurisprudence (Usul al-Fiqh). The study analyzes the maxim’s origin, its application in deriving legal rulings (ahkam), and its relevance in contemporary issues. The research highlights how this principle ensures legal stability and protects individuals from unnecessary hardship by maintaining the status quo in the absence of clear evidence to the contrary. Using classical sources and modern case studies, the paper demonstrates the maxim’s practicality in diverse fields such as worship, financial transactions, medicine, and forensic sciences. The study concludes that this principle not only upholds justice but also aligns with contemporary legal standards in areas like due process and burden of proof.
